(Kreu I, Pika 1 e Rregullores së Përgjithshme)		 1.1. Legal Framework: This Guide is drafted pursuant to:

  • Law No. 8096, dated 21.03.1996, “On Cinematography”, as amended;
  • Law No. 109/2021, “On the Ratification of the Council of Europe Convention on Cinematographic Co-Production (Revised), Rotterdam, 30.01.2017”;
  • Bilateral and multilateral international agreements on cinematographic co-production ratified by the Republic of Albania;
  • Law No. 35/2016, “On Copyright and Related Rights”;
  • The Statute of the National Center of Cinematography (QKK) and the General Regulation on Financial Support.
 1.1. Kuadri Ligjor: Ky Udhëzues është hartuar në mbështetje të:

  • Ligjit Nr. 8096, datë 21.03.1996, “Për Kinematografinë”, të ndryshuar;
  • Ligjit Nr. 109/2021, “Për ratifikimin e Konventës së Këshillit të Evropës për Bashkëprodhimin Kinematografik (e rishikuar), Roterdam, 30.01.2017”;

Purpose: This Guide sets forth the eligibility criteria, application procedures, financial thresholds, mandatory documentation, and contractual obligations governing financial support granted by QKK for Minority Co-Production Projects for Feature-Length Fiction Films. 1.2. Qëllimi: Ky Udhëzues përcakton kriteret e kualifikimit, procedurat e aplikimit, kufijtë financiarë, dokumentacionin e detyrueshëm dhe detyrimet kontraktore që rregullojnë mbështetjen financiare të dhënë nga QKK për Projektet e Bashkëprodhimeve në Pakicë për Filmin Artistik me Metrazh të Gjatë.

Prevailing Provisions: In the event of any discrepancy between informational summaries and the regulatory framework, the provisions of the General Regulation on Financial Support and the terms of the respective Call for Applications shall prevail. 1.3. (Kreu I & Kreu V, Pika 21)		 2.1. Minority Co-Production Projects: Feature-length cinematographic projects realized within the framework of an international co-production agreement between an Albanian Cinematographic Production House (Shtëpi Kinematografike – SHK), acting as a minority co-producer, and one or more foreign production companies, wherein the majority co-producer is a foreign legal entity established outside the Republic of Albania. 2.1. Projektet e Bashkëprodhimeve në Pakicë: Projekte kinematografike me metrazh të gjatë të realizuara në kuadër të një marrëveshjeje ndërkombëtare bashkëprodhimi ndërmjet një Shtëpie Kinematografike shqiptare (SHK), në cilësinë e bashkëproducentit në pakicë (minorancë), dhe një ose më shumë shoqërive prodhuese të huaja, ku bashkëproducenti në shumicë (mazhorancë) është subjekt juridik i huaj i themeluar jashtë Republikës së Shqipërisë.

Chapter IV
(Kreu IV, Organizimi i Thirrjeve)		 3.1. Publication of Calls: The annual calendar of Calls for Applications is approved by the Chairperson of QKK and published within the first two months of each calendar year. Calls may be opened two or more times per year and remain open for 10 to 30 calendar days. 3.1. Publikimi i Thirrjeve: Kalendari vjetor i Thirrjeve për Aplikim miratohet nga Kryetari i QKK-së dhe publikohet brenda dy muajve të parë të çdo viti kalendarik. Thirrjet mund të çelen dy ose më shumë herë në vit dhe qëndrojnë të hapura nga 10 deri në 30 ditë kalendarike.

(Kreu V, Rregulla të Përgjithshme, Pika 1)		 3.2. Mandatory Dual Submission: All competing projects must be submitted both:

  • Electronically, via QKK’s dedicated online application platform (https://qkk.systems); and
  • In physical hard copy, delivered to the Protocol Office of QKK prior to the official deadline and time specified in the Call for Applications.
 3.2. Dorëzimi i Dyfishtë i Detyrueshëm: Të gjitha projektet konkurruese duhet të dorëzohen njëkohësisht:

  • Elektronikisht, nëpërmjet platformës së dedikuar online të QKK-së (https://qkk.systems); dhe
  • Fizikisht (në kopje fizike), pranë Zyrës së Protokollit të QKK-së përpara afatit dhe orës zyrtare të përcaktuar në Thirrjen për Aplikim.

(Kreu V, Pikat 2–5)		 3.3. Quotas and Concurrent Contracts:

  • An SHK may apply with only one (1) project per call, unless explicitly specified otherwise in the Call for Applications.
  • A project may not be submitted to QKK for financing more than three (3) times in total.
  • A director may apply with only one (1) project per call.
  • An SHK holding an active contract with QKK for a majority-funded Feature-Length Fiction Film or Debut Feature Film is eligible to apply in the Minority Co-Production category, provided the completion of principal photography of its ongoing contracted project has been formally verified by QKK prior to the announcement of the call.
 3.3. Kuotat dhe Kontratat e Njëkohshme:

  • Një SHK ka të drejtë të aplikojë vetëm me një (1) projekt për çdo thirrje, përveç rasteve kur përcaktohet ndryshe në Thirrjen për Aplikim.
  • Një projekt nuk mund të paraqitet për financim në QKK më shumë se tre (3) herë gjithsej.
  • Një regjisor ka të drejtë të aplikojë vetëm me një (1) projekt për çdo thirrje.
  • Një SHK që ka një kontratë aktive me QKK-në për Film Artistik me Metrazh të Gjatë ose Vepër të Parë ka të drejtë të aplikojë në kategorinë e Bashkëprodhimeve në Pakicë, me kusht që përfundimi i fazës së xhirimeve të jetë verifikuar zyrtarisht nga QKK përpara shpalljes së thirrjes.

Chapter III
(Kreu III, Regjistrimi i SHK-ve)		 4.1. Eligible Applicant (Albanian Minority Co-Producer):

  • Must be a Cinematographic Production House (SHK) legally established as a juridical person and headquartered in the Republic of Albania.
  • Must hold active status with the National Business Center (QKB) and be registered with QKK for the current calendar year (valid until December 31).
 4.1. Aplikanti i Kualifikueshëm (Bashkëproducenti Shqiptar në Pakicë):

  • Duhet të jetë Shtëpi Kinematografike (SHK) e themeluar si person juridik me seli në territorin e Republikës së Shqipërisë.
  • Duhet të ketë status aktiv në Qendrën Kombëtare të Biznesit (QKB) dhe të jetë e regjistruar në regjistrin zyrtar të QKK-së për vitin kalendarik përkatës (deri më 31 Dhjetor).

(Kreu I & Kreu V, Pika 21)		 4.2. Co-Production Proportions & Confirmed Financing:

  • Multilateral: Albanian share must be between 5% and 80% (Revised CoE Convention, Law No. 109/2021).
  • Bilateral: Albanian share must be between 10% and 90%, unless treaty specifies otherwise.
  • 70% Majority Financing Rule: At least 70% of the total production budget must be secured by the foreign majority co-producer at application.
  • Private Financing: Recognized only when backed by binding legal instruments and verifiable guarantees under Chapter V, Point 9.
 4.2. Proporcionet e Bashkëprodhimit & Financimi i Siguruar:

  • Shumëpalëshe: Pjesëmarrja shqiptare mes 5% dhe 80% (Konventa e Rishikuar e KE, Ligji Nr. 109/2021).
  • Dypalëshe: Pjesëmarrja shqiptare mes 10% dhe 90%, përveç kur parashikohet ndryshe.
  • Rregulli i Financimit 70%: Të paktën 70% e buxhetit total duhet të jetë e siguruar nga prodhuesi i huaj në mazhorancë.
  • Financimi Privat: Njihet vetëm kur vërtetohet me instrumente ligjore dhe garanci të verifikueshme sipas Kreut V, Pika 9.

(Kreu V, Pika 21 & Thirrja)		 4.3. Artistic Participation & Territorial Spend:

  • Verifiable artistic/technical participation of Albanian filmmakers, cast, crew, or services proportional to contribution.
  • Up to the call cap (typically up to 7,000,000 ALL), at least 90% of the QKK grant must be spent directly within Albania.
  • Display QKK logo and credit QKK in the film and promotional materials.
 4.3. Pjesëmarrja Artistike & Shpenzimi në Territor:

  • Pjesëmarrje e verifikueshme artistike/teknike e kineastëve, kastit ose shërbimeve shqiptare në përpjesëtim me kontributin.
  • Deri në tavanin e thirrjes (zakonisht deri në 7,000,000 Lekë), të paktën 90% e grantit të QKK-së duhet të shpenzohet në Shqipëri.
  • Vendosja e logos së QKK-së dhe përmendja e mbështetjes në film dhe materiale.

6. Content Restrictions, Legal Disputes, and Disqualification / Kufizimet e Përmbajtjes, Konfliktet Ligjore dhe Skualifikimi

(Kreu I, Pika 4)		 6.1. Prohibited Content: QKK shall not authorize, finance, or support audiovisual projects that:

  • Openly incite violation of fundamental human and constitutional rights;
  • Harm honor and prestige of Albanian history and nation;
  • Contain or incite racial, ethnic, religious, or social hatred, terrorism, or discrimination;
  • Promote cult of violence or fundamentalist ideologies.
 6.1. Përmbajtja e Ndaluar: QKK nuk miraton, nuk financon dhe nuk mbështet projekte që:

  • Nxitin hapur shkeljen e të drejtave themelore të njeriut dhe kushtetuese;
  • Cenojnë nderin dhe prestigjin e historisë dhe kombit shqiptar;
  • Përmbajnë ose nxisin urrejtje racore, etnike, fetare apo sociale, terrorizëm ose diskriminim;
  • Promovojnë kultin e dhunës ose ideologji fondamentaliste.
Chapter V (Point 6)
(Kreu V, Pika 6)		 6.2. Legal Conflicts and Litigation: Any SHK, producer, or author involved in a legal dispute over the project is subject to:

  • Application Stage: Automatic disqualification.
  • Subsequent Stages: Suspension of financing until a final, binding court judgment (*vendim gjyqësor i formës së prerë*). If ruled against SHK, contract is terminated and funds returned.
 6.2. Konfliktet Ligjore dhe Proceset Gjyqësore: Çdo SHK, producent apo autor i përfshirë në konflikt ligjor i nënshtrohet:

  • Fazës së Aplikimit: Skualifikimit automatik.
  • Fazave Pasardhëse: Pezullimit të financimit deri në vendim të formës së prerë. Nëse vendimi është kundër SHK-së, kontrata zgjidhet dhe fondet kthehen.
QKK Sanctions Notice
(Komunikatat mbi Sanksionet)		 6.3. Exclusion of Sanctioned Entities: QKK does not finance cinematographic co-productions involving entities or individuals penalized or designated by the U.S. Department of the Treasury (OFAC) or equivalent international sanctions regimes. 6.3. Përjashtimi i Subjekteve të Sanksionuara: QKK nuk financon bashkëprodhime me subjekte ose individë të penalizuar apo të shpallur nga Departamenti i Thesarit i SHBA-së (OFAC) ose regjime të ngjashme sanksionesh.

7. Evaluation, Contracting, and Disbursement / Vlerësimi, Lidhja e Kontratës dhe Lëvrimi i Fondeve

Chapter VI
(Kreu VI, Vlerësimi)		 7.1. Evaluation Procedure:

  • Administrative Verification: QKK checks formal completeness. Incomplete applications are disqualified.
  • Artistic & Financial Assessment: Evaluated by the Project Approval Council (KMP) on artistic merit and by the Financial Commission on budget feasibility.
  • Approval: Final decisions approved by the Chairperson of QKK.
 7.1. Procedura e Vlerësimit:

  • Verifikimi Administrativ: QKK verifikon plotësinë formale. Aplikimet e paplota skualifikohen.
  • Vlerësimi Artistik & Financiar: Vlerësohet nga Këshilli Miratues i Projekteve (KMP) për vlerat artistike dhe Komisioni Financiar për buxhetin.
  • Miratimi: Vendimet përfundimtare miratohen nga Kryetari i QKK-së.
Chapter V (Point 8) & Chapter VII
(Kreu V, Pika 8 & Kreu VII)		 7.2. Contracting Timeframes & Re-Competition Rule:

  • Winning applicants must fulfill contract prerequisites within the regulatory deadline.
  • Mandatory Re-Competition: Pursuant to Chapter V, Point 8, Minority Co-Production projects that fail to complete contracting prerequisites lose their right and must re-enter competition in a subsequent Call.
 7.2. Afatet e Kontraktimit & Rregulli i Rikonkurrimit:

  • Aplikantët fitues duhet të plotësojnë kushtet e kontratës brenda afatit rregullator.
  • Rikonkurrimi i Detyrueshëm: Bazuar në Kreun V, Pika 8, projektet që nuk plotësojnë kushtet e kontraktimit humbasin të drejtën dhe duhet të rikonkurrojnë në Thirrjen pasardhëse.
Chapter VII & VIII
(Kreu VII & VIII, Monitorimi)		 7.3. Disbursement and Final Audit: Financial support is disbursed in tranches into a dedicated project bank account opened by the Albanian SHK, subject to phase monitoring by QKK, an independent certified audit report verifying local spend in Albania, and delivery of archival copies. 7.3. Lëvrimi i Fondeve dhe Auditimi Përfundimtar: Mbështetja lëvrohet me këste në një llogari bankare të dedikuar për projektin, kundrejt monitorimit nga QKK, dorëzimit të raportit të auditimit të pavarur që vërteton shpenzimet në Shqipëri, dhe dorëzimit të kopjeve arkivore.
